GENERAL RENTAL CONDITIONS AND DISCLAIMER

Safety rules

It is compulsory to wear a lifejacket. Personal flotation devices must be worn at all times during the trip.

 

Each boat is equipped with a fire extinguisher, a bailer, a 10-metre rope and mooring points at the bow and stern.

 

If you come across a barge or ship on the canal, move to the opposite side and park while it passes.

 

Never pass barges or ships under the bridge and the reduced traffic zone (twin bridges lock) which links the Brienne canal and the port at the mouth of the canal.

 

If you see or hear a barge arriving under the bridge and/or in the lock of the twin bridges, you must let it pass and facilitate its manoeuvre in the port to turn around. You can take shelter behind the red buoys in the harbour or park alongside the canal if you are in the Brienne canal.

 

It is forbidden to stick to moving or parked barges.

 

It is forbidden to litter the canal and/or the port.

You will be asked to show proof of identity, which will be kept in a safe place for the duration of the trip in order to guarantee the correct use of the equipment hired.

In the event of accidental damage to or loss of the boat, its equipment and materials, poor maintenance, abandonment or late return of the boat, a charge will be made to cover the costs incurred.  

The costs to be reimbursed for loss or damage to the following items on the boat are given as an indication and are not exhaustive: Scratches or major damage: €17 to €30 - Adult lifejacket: €15 - Child lifejacket: €20 - Oar: €40 - Fire extinguisher: €25 - Scoop: €5. Damage to the boat is not listed and will be calculated on a case-by-case basis. Any damage to the boat or loss or breakage of its equipment must be reimbursed by the hirer.

Bail

A deposit of €100 (one hundred euros) will be required before the boat trip and will be returned at the end of the hire period if the boat, equipment and facilities are returned at the agreed time and in the same condition as when the boat was taken over before the hire period and if the boat has not caused any damage to a third party. A form of identification (identity card or passport) will be requested in order to verify age and note the identifier on the discharge.

In the event of accidental damage to or loss of the boat, its equipment and materials, poor maintenance, abandonment or late return of the boat, part or all of the security deposit will be deducted to cover the costs incurred.

Damage to the boat is not listed and will be calculated on a case-by-case basis. Any damage to the boat or loss or breakage of its equipment must be reimbursed by the hirer. The amount may exceed the initial deposit.

Cancellation, postponement, refund and termination by the tenant

No cancellations or refunds can be made. In the event of weather conditions that could pose a risk during sailing (strong winds, heavy rain, etc.) as defined by the rental company, the customer may request a credit note or move the booking to another day.

Cancellation by the lessor Toulouse Em'Barque

In the event of problems with the equipment or any other unforeseen circumstances preventing the correct use of the equipment or jeopardising the safety of customers, Toulouse Em'Barque will have the right to cancel the reservation on the agreed date. The rental base will assign another boat with the same load capacity, or will make a refund without this resulting in damages.

Toulouse Em'Barque may also terminate the rental contract in the event of weather conditions or forecasts that jeopardise customer safety.

 

Lastly, Toulouse Em'Barque reserves the right to exclude a client who is intoxicated and therefore not to hand over the boat.  The same applies to any customer whose behaviour is likely to :

disrupt the smooth running of briefings,

suggest that there is a risk of compromising the safety of the customers in question.

 

In this case, the customer will not be entitled to any refund or compensation. 

Boat support

The customer(s) must be present 15 minutes before the ride to make payment, pay the deposit, sign the waiver including the general hire conditions, receive a reminder of the safety rules and choose the lifejacket(s) according to each person's weight.

Obligations of the tenant during the rental

The hirer must be of legal age. Children under the age of 12 must wear a lifejacket appropriate for their age and weight. The hirer(s) must comply with river navigation regulations and the instructions given by the hire company. They must not sail outside authorised areas. They may not take on board more people than the authorised number. Animals are not allowed on board the boats.

 

The hirer expressly releases Toulouse Em'barque and the Florian Lebas company from any liability as owner or otherwise for any breach of these prohibitions and will be solely liable to the competent authorities for any proceedings, prosecutions, fines and confiscations incurred by him in this respect, even in the event of involuntary fault on his part. If the hired boat is seized, the Hirer must pay the Owner a contractual indemnity corresponding to the hire rate in force. If the hired boat is confiscated, the Hirer must reimburse the value of the boat within one month.

Damage during rental

Any accident on board the boat must be reported immediately to the boat hire, who will indicate the procedure to be followed. No repairs may be carried out by the hirer without the prior agreement of the hire company. In addition, the driver will have to fill in and sign a form to declare the damage and have any third parties or witnesses sign it. No compensation will be paid to the hirer if the rental is disrupted by an accident, whether he/she is the cause or the victim. The driver will be held personally liable for the consequences of an accident in which the civil or criminal liability of a member of the crew is sought without calling into question the boat or its equipment.

Return of the boat

The hirer must return the boat and its equipment in good working order and clean.

The boat must be returned to the location, on the date and at the time stipulated in the contract, unless something unforeseeable occurs beyond the control of the driver. Any hour started will be charged. Upon return, the hirer must report to a member of Toulouse Em'barque. The rental period will end when the boat, equipment and materials are returned in the same condition in which they were handed over. Toulouse Em'barque reserves the right to invoice the hirer for any prejudice caused by the abandonment or late return of a boat during the hire period.

Unforeseen restrictions during navigation

In the event of closure of the waterway for technical reasons or caused by the administrative police, strikes, floods or drought, other bad weather, or other unforeseen circumstances beyond the control of the hire company, Toulouse Embarque will not be held responsible and will therefore not be liable to pay any compensation whatsoever to the hirer. In the event that these events make sailing impossible, Toulouse Em'barque will pay a credit note for the same amount as the cancelled service, to be used at a later date, the hirer will not be obliged to make a refund.

Supervision of minors

Minors unaccompanied by an adult (legal guardian) are not accepted on the boats.

Disputes

The parties will endeavor to resolve amicably any difficulties that may arise in the performance of the contract. If no amicable agreement can be reached, all disputes relating to the validity, interpretation and execution of this agreement will be governed exclusively by the rules of French law.

All disputes, of whatever nature, will fall within the jurisdiction of the French civil and commercial courts, including ruling in summary proceedings.

For all disputes relating to sales made by Toulouse Em'Barque and with a view to the application or interpretation of these general conditions of sale, and in the absence of an amicable resolution, the place of competent jurisdiction will be the court of Toulouse.

Cleanliness and environment

Respect the flora, fauna and residents living around and on the canal. It is therefore absolutely forbidden to throw away any waste, even if it is biodegradable. Bags or boxes can be lent to dispose of the waste and if this measure is forgotten or unavailable, the waste must be kept on board the boat and unloaded on return to port.

It is also asked to respect the tranquility of the surroundings according to the hours of walks. Music through a baffle is accepted provided that the sound volume remains reasonable.

Personal items

Toulouse Em’Barque disclaims all liability in the event of loss of objects around or in the canal such as telephones, speakers, keys, etc. It is therefore advisable to board with a minimum of valuables.
